Refusal letters

«Refusal letter» is a document in which it is underlined that given production does not concern objects of obligatory certification in the GOST-R system.

"Refusal letter" is made out on the form of a certification organ and assured by the seal.

It may be demanded by deliveries of production for customs organs and for trade realisation.

There are 2 kinds of "Refusal letters»:

  1. Refusal letter for customs. Their registration are engaged authorised in Federal Agency on technical regulation and metrology (ROSTEKHREGULIROVANIE) of the organisation (VNIIS, FGU Kaliningrad CSM and VNIIMASH).

    Documents necessary for registration:

    • contract with specification;
    • invoice;
    • production description (technical characteristics, scope, appearance);
    • TN VED production code;
    • demand with signature and seal of firm-applicant with instructions of requisites of firm-applicant;
    • letter of attorney from firm-applicant on a physical person with right of receving the letter.
  2. Refusal letter for trade. Certification organs of production accredited in ROSTEKHREGULIROVANIE are engaged in its registration. Thus they are guided by the List of Goods for which acknowledgement of doing obligatory certification at release on customs territory of the Russian Federation is required.

    Documents necessary for registration:

    • Production description (technical characteristics, scope, appearance);
    • OKP code of production;
    • demand with signature and seal of the firm-applicant with instructions of requisites of firm-applicant;
    • letter of attorney from firm-applicant on physical person with right of receiving the letter.

Federal agency on technical regulation and metrology has defined list of production which does not require granting of GOST P certificates and may be let out on customs territory of Russian Federation.:

  1. Production which was in use;
  2. Production imported as spare parts for earlier imported on customs territory of Russian Federation of certificated finished articles, under condition of representation of copies of certificates of conformity on earlier imported above-stated finished articles and acknowledgement that given spare parts are used at manufacturing of finished articles and obligations about use of spare parts only for a complete set of specified finished articles or for their maintenance service and repair are brought in the design documentation on a product, and also;
  3. Production imported as tests and samples for carrying out tests with a view of certification;
  4. Production which imported by physical persons and has been not intended for industrial or other commercial activity (except for cases of import over established cost and quantitative quotas);
  5. Production intended for official use of representatives of foreign states and international intergovernmental organisations, and also for their personnel.

By the way:

In January, 2004 obligatory holographic labels for Refusal customs letters which are given out by VNIIS have been released. The given measure is intended to protect letters from fake.

  • Letter of Federal Customs Service from December, 19th, 2006 N 06-73/44906 "About the list of goods for which acknowledgement of doing obligatory certification at release on customs territory of Russian Federation (with changes from September, 20th, 2007).

  • Order of GOSSTANDART of Russian Federation from September, 27th, 2002 N 214 "About preparation and delivery of explanations concerning reference of production and services (works) to objects of obligatory acknowledgement of conformity" (with changes from May, 15th, 2003)
  • Agreement from 17.03.2003 N 07-61/10816 "About giving out permissions by VNIIS"
